PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES

Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and ez enRoute. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. ez enRoute may immediately terminate these Terms or any Services with respect to you, or generally, cease offering or deny access to the Services or any portion thereof, at any time for any reason.

ez enRoute may amend the Terms related to the Services from time to time. Amendments will be effective upon ez enRoute’s posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.

Our collection and use of personal information in connection with the Services is as provided in ez enRoute’s Privacy Statement located at www.ezenroute.com. ez enRoute may provide to a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, queries or concerns, and such information or data is necessary to resolve the complaint, dispute or conflict.

Services

The Services constitute a technology platform that enables users of ez enRoute’s mobile applications or websites provided as part of the Services (each, an “Application”) to enable schools and parents/guardians to track their children in real-time during the routine school pick up and drop-offs. Driver application enabling the driver to know the information of the trip, of anticipated children on-boarding and off-boarding bus at a particular stop. These services are made available solely for your personal, noncommercial use. You acknowledge that ez enRoute does not provide transportation services or function as a transportation carrier and that all such transportation services are provided by independent third-party providers that are not employed by ez enRoute or any of its affiliates.

Restrictions

You may not: (a) remove any copyright, trademark or other proprietary notices from any portion of the Services; (b) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by ez enRoute; (c) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (d) link to, mirror or frame any portion of the Services; (e) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (f) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.

Ownership

The Services and all rights therein are and shall remain ez enRoute’s property. Neither these Terms nor your use of the Services conveys or grant to you any rights: (a) in or related to the Services; or (b) to use or reference in any manner ez enRoute’s company names, logos, product and service names, trademarks or services marks or those of ez enRoute.

User Accounts

In order to use ez enRoute and its services the Services, you must register for and maintain an active personal account (“Account”). You must be the authorized parent or guardian in agreement and in the knowledge of your respective school to obtain an Account. Account registration requires you to submit your personal information, such as your name, address, mobile phone number kid(s) name, age, and grade. You agree to maintain accurate, complete, and up-to-date information in your Account. Any modifications in your current credentials must be reported to the school to approve and incorporate changes. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account login information. Unless otherwise permitted by ez enRoute and your school in writing, you may only possess one Account.

User Requirements and Conduct

You may not authorize third parties to use your Account, and you may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when using the ez enRoute application, and you may only use the Services for lawful purposes. You will not, in your use of the Services, cause nuisance, annoyance, inconvenience, or property damage, to any involved party. In certain instances, you may be asked to provide your unique PIN as proof of identity to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity.

Network Access and Devices

You are responsible for obtaining the data network access necessary to use the application. Your mobile network’s data and messaging rates and fees may apply if you access or use the application from a wireless-enabled device and you shall be responsible for such rates and fees. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the application and any updates thereto. ez enRoute does not guarantee that the Services, or any portion thereof, will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.

Disclaimer

ez enRoute makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of the services, or that the services will be uninterrupted or error-free. ez enRoute does not guarantee the quality, suitability, safety or ability of third party providers. You agree that any risk arising out of your use of the services remains solely with you.

Limitation of Liability

ez enRoute shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost data, personal injury or property damage related to, or resulting from any use of the services, even if has been advised of the possibility of such damages. ez enRoute shall not be liable for any damages, liability or losses arising out of: (a) your use of or reliance on the services or your inability to access or use the services; or (b) any transaction or relationship between you and any third-party provider, even if ez enRoute has been advised of the possibility of such damages. ez enRoute shall not be liable for delay or failure in performance resulting from causes beyond ez enRoute’s reasonable control.

Indemnity

You agree to indemnify and hold ez enRoute and its representatives, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (a) your use of the Services (b) your breach or violation of any of ez enRoute’s Terms; or (c) your violation of the rights of any third party, including Third-Party Providers.

User Privacy Statement

ez enRoute collects information about you when you use our mobile application or web interface. We collect the information you provide directly to us, such as when you create or modify your account, send us queries, or otherwise communicate with us. This information may include name, email, phone number, postal address, profile picture, comments or notes, and other information you choose to provide.

This Privacy Statement applies to users anywhere in the world who use our apps to enquire about the status of pupils or to track the bus on its route to and from the school. If you interact with our application as either a Parent or a Driver, the respective privacy statements apply to your different interactions.

Information Collection

When you use ez enRoute application, we collect your information in these forms:

  • Location Information: As a Driver, when you use ez enRoute for students’ pickup or dropoff, we collect precise location data about the trip from the ez enRoute app used by the Driver.
  • Usage and Preference Information: We collect information about how you and site visitors interact with our Services, preferences expressed, and settings are chosen. In some cases, we do this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers.
  • SOS Message: Our Services facilitate communications between Users and Drivers. In connection with facilitating this service, we receive message data, including the date and time of the SOS message, the parties’ phone numbers, and the content of the SOS message.
  • Log Information: When you interact with the Services, we collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, or the type of browser.

We may use the information we collect about you to:

  • Provide, maintain, and improve our Services, including, for example, to provide products and services you request (and send related information), develop new features, provide customer support to Users and Drivers, develop safety features, authenticate users, and send product updates and administrative messages;
  • Perform internal operations, including, for example, to prevent fraud and abuse of our Services; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends.

Platform Permissions

iOS and Android have defined certain types of device data that apps cannot access without your consent. And these platforms have different permission systems for obtaining your consent. At the time of installing the application on either iOS or Android, required permissions are explicitly stated, where ez enRoute application requires the user’s consent prior to completing the installation of the application on a user’s device.

Account Information

To modify your account details, or to discontinue your information, please contact your school. The request, once approved by the school authority, will be incorporated in ez enRoute’s application within 48 hours.

Access Rights

ez enRoute will comply with individual requests regarding access, correction, and/or deletion of the personal data it stores in accordance with applicable law.
